COMPETITION - TERMS & CONDITIONS
Please note that entry in the Asianaffair competition is subject to these
terms and conditions, the Website Terms of Use and the Asianaffair Privacy
Policy. Therefore please read these documents carefully before submitting
your entry. By entering this competition you are deemed to accept these
terms and conditions.
All references in these terms and conditions: to the "Website"
refer to this Website www.asianaffair.com and/or www.aaffair.com ; to “you”
and “your” are to you; and to “we”, “us”
and “our” are to Asian Affair Ltd.
1. INTRODUCTION
1.1 This competition is being run by Asian Affair Ltd.
(“Asian Affair”). Please direct all correspondence in connection
with the competition to Asian Affair Ltd. at info@asianaffair.com
1.2 Please retain a copy of these terms and conditions
for your reference.
2. ELIGIBILITY
2.1 This competition is open to persons of any age however the entrant must be submitted by somebody aged 16 years of
age and over.
2.2 Participants who enter this competition from outside
the United Kingdom confirm by entering the Asianaffair competition that
they have not breached any laws in their country of residence by entering
this competition. Asianaffair does not accept any responsibility for entrants
who enter this competition unlawfully.
2.3 Failure to comply with any of these terms and conditions
will result in the disqualification of your Entry (see condition 3.1 below
for definition of "Entry") and Asianaffair reserves the right
to disqualify any Entry, at any time, in its absolute discretion.
3. TO ENTER, RATE & VOTE
3.1 To enter in the Asianaffair competition you must first
register on our Website and provide either your audio or video entry in
accordance with these rules you will see on the site.
3.2 You need to be a member to rate the video. Only
one rating maybe registered per audio/video entry per IP address.
3.3 You need to be a member to vote via our polling
system. Only one vote maybe registered per IP address. The vote will take
place after the competition period has expired which is outlined in section
4.
3.4 The aim of the Asianaffair competition is to allow
users to share their home-made videos and audio samples with other users,
who may then rate for their favourite video or audio entry. In order to
enter the competition, you must upload to the Website a video or audio sample
which falls into one of the following categories: Singers, Band or Group,
Comedy, Acting, Director or Film, Animation, Dance, Music, Any Other (the
"Entry"). Entrants may choose the category, or categories, in
which the video should be entered. Entries must not exceed 10 minutes in
length or 100MB in size.
3.5 All Entries are subject to the Website Terms of Useand
by entering the Asianaffair competition, you warrant and represent that
your Entry complies with those Terms of Use.
3.6 We reserve the right to remove without notice and at
our sole discretion any Entry which we consider to be in breach of the Website
Terms of Use.
4. TO WIN
4.1 The competition will start officially at [00:01] GMT on [1st March
2008] ("Start Date") and will end at [23:59] GMT on [31st March
2009] ("End Date"). The competition will be divided into 6 bi-monthly
mini competitions as follows:
(a) first mini competitions starting at [00:01] [1st March 2008] and
ending at [23:59] on [31st May];
(b) second mini competitions starting at [00:01] [1st June 2008] and ending
at [23:59] on [31th July 2008];
(c) third mini competitions starting at [00:01] [1st August] and ending at
[23:59] on [30th September 2008];
(d) fourth mini competitions starting at [00:01] [1st October] and ending
at [23:59] on [30th Novemeber 2008];
(e) fifth mini competitions starting at [00:01] [1st December] and ending
at [23:59] on [31st January 2008];
(f) sixth mini competitions starting at [00:01] [1st February] and ending
at [23:59] on [31st March 2009];
each mini competition has a bi-monthly life spanm except the initial one which has a 3 month life span.
4.2 The voting for the winner(s) will start at [00:01]
GMT at the end of the submission period of each of the 6 bi-monthly mini
competitions and will last a period of 2 weeks:
(a) first mini competitions voting period starting at [00:01] [1st June
2008] and ending at [23:59] on [14th June 2008];
(b) second mini competitions voting period starting at [00:01] [1st August]
and ending at [23:59] on [14th August];
(c) third mini competitions voting period starting at [00:01] [1st October]
and ending at [23:59] on [14th October];
(d) fourth mini competitions voting period starting at [00:01] 1st December]
and ending at [23:59] on [14th December];
(e) fifth mini competitions voting period starting at [00:01] [1st February]
and ending at [23:59] on [[14th February 2008];
(f) sixth mini competitions voting period starting at [00:01] [1st April]
and ending at [23:59] on [14th April 2009];
each voting period for each mini competition has a two week life span.
4.3 Entries may be submitted in any or all six bi-monthly
mini competition, but note condition 4.4 below. Users/Visitors will rate
Entries. In each bi-monthly mini competition period, the top 20 rated audio/video
samples will go into a poll. There must be a minimum of 100 people that have rated any enry for it to be entered into the top 20. The top three entries with most votes will
be selected and entered into the final. They will also win a selection of
prizes set out for that period. The three winning Entries from each mini-competition
in any period cannot be submitted in a subsequent period. They will reside
on our winners section of our Website.
4.4 At the end of each bi-monthly period, all Entries,
with the exception of the three winning Entries that have been put forward
to the final, will automatically be entered into the next bi-monthly period
unless the entrant contacts Asianaffair via e-mail at delete@asianaffair.com
to confirm that they do not want their Entry to be automatically re-entered
into the next mini-competition. They must clearly make this entry distinguishable
by providing exact name of entry, their details and any other information
they have available.
4.5 The final will consist of the winning eighteen Entries
from each bi-monthly competition, up to a total of 18 Entries. The final
voting period will commence at [00:01] GMT on [14th April 2009] and will
last for a period of two weeks and will end at [23.59] GMT on [30th April
2009].
4.6 All votes that an Entry has received prior to the final
will be deleted and all Entries will begin the final with zero votes. The
winner of the final will be the Entry which has obtained the highest number
of valid votes during the voting period for the final. There are three prizes
available; the sum of US $10,000 for the winning Entry for the final; the
sum of US $5,000 for the runner up Entry for the final; the sum of US $2,500
for the third place Entry for the final;
4.7 Winning Entries must comply with these terms and conditions
and the Website Terms of Use and must not contain any Inappropriate Content
(as defined in Terms of Use). Asianaffair reserves the right at its sole
discretion to disqualify any Entry which appears to be in breach of this
condition. Asianaffair's decision in this respect will be final and no correspondence
will be entered into regarding such decision.
4.8 Winners will be notified at the email addresses provided
when registering with Asianaffair within 72 hours (usually 24 hours) of
the end of the voting for the bi-monthly competition or the End Date, as
appropriate, subject to Asianaffair’s right to examine or verify information
provided in the Entry or by the entrant. The winners and the winning Entries
will be announced on our Website together with the results of any previous
competitions carried out by Asianaffair.
5. RATING/VOTING
5.1 By rating or voting in the Asianaffair competition
you are deemed to accept these terms and conditions, the Asianaffair Privacy
Policy and the Website Terms of Use.
5.2 You may rate or vote at any time after the Start Date
and before the End Date. Any votes received before or after these times
will not be registered.
5.3 Your rating or vote will be registered by clicking
on the “rating stars” or "vote" button in the poll
under your favourite Entry. Voters may vote as many times as they wish but
may not vote more than once for the same Entry.
5.4 There must be a minimum of 100 people that have rated any enry for it to be entered into the top 20.
6. OWNERSHIP OF ENTRIES
6.1 All Entries submitted as part of the Asianaffair competition
shall remain the property and copyright of the entrant. By entering this
competition, the entrant hereby grants to Asianaffair, its sub-licensees
and assignees, a non-exclusive, perpetual, irrevocable, royalty-free, worldwide
licence to use the Entry for any purpose and in any media whatsoever including
the right to assign, sub-license or transfer the rights to a third party.
7. DISCLAIMER
7.1 Asianaffair will not be liable for any inability to
enter the Asianaffair competition or vote for any Entries due to any interruption
or delay to your access to the Website for any reason.
8. WINNER PUBLICITY
8.1 Entrants accept that if they win any prize, Asianaffair
will have the right to use their name, age, town or city of residence and
photograph for the purposes of announcing the winner of the competition
and for promotional purposes.
8.2 By entering the Asianaffair competition you agree that
Asianaffair may contact you from time to time in the future about our other
services.
9. GENERAL
9.1 If any of these terms and conditions or any provisions
of a contract between you and us are determined by any competent authority
to be invalid, unlawful or unenforceable to any extent, such term, condition
or provision will to that extent be severed from the remaining terms, conditions
and provisions which will continue to be valid to the fullest extent permitted
by law.
9.2 You and we acknowledge that, in entering into a contract,
you have not and we have not relied on any representation, undertaking or
promise given by the other or implied from anything said or written in negotiations
between you and us prior to such contract except as expressly stated in
these terms and conditions.
9.3 The Contracts (Rights of Third Parties) Act 1999 shall
not apply to these terms and conditions. No party who is not a party to
these terms and conditions shall have the right (whether under the Contracts
(Rights of Third Parties) Act 1999 or otherwise) to enforce any term which
expressly or by implication confers a benefit on that person without the
prior written consent of the parties which must refer to this condition
9.3.
10. LAW & JURISDICTION
10.1 These terms and conditions shall be governed by, and
construed in accordance with, English law and shall be exclusively subject
to the jurisdiction of the courts of England.

MODERATION AIMS
Asianaffair is intended for use by the international public aged 16 years
old and above.. The overarching objective of this moderation policy is to
ensure that an interesting and open exchange of views and content is stimulated
whilst ensuring that Asianaffair is as safe an environment as possible for
its intended participants.
Asianaffair gathers many differing opinions and experiences. You are certain
to find opinions that you disagree with and some which you may find offensive.
Our goal, at all times, is to provide a space where free expression can
take place whilst offending as few people as possible.
We try to be as fair as we can when moderating but in a large community
of users, with differing viewpoints, there will always be some people that
will not be happy with the outcome. Whilst we regret this, please appreciate
that the decisions we make with regard to moderation are based on what it
is felt is best for the community as a whole.
WHO SETS THIS POLICY?
This policy is a document set by Asianaffair.com, who make up the moderation
team. No single person is wholly responsible for this policy.

HOW TO REPORT ABUSE
You can report abuse by clicking on the “Report” button (the
small text link) or the blue button named so next to each video, music,
photo etc. Please note that abuse reports are confidential and are not seen
by the user who posted the item. When you click on the “Report”
button, an email is automatically sent to a Moderator who will process the
issue.
LIBELOUS CONTENT
If you are not an Asianaffair user and you feel you have been defamed or
libeled, your first step should be to send us a message by clicking
here in order to have the offending post reviewed and if deemed to be
inappropriate then it shall be removed as soon as possible.
WHY WAS MY ABUSE REPORT NOT ACCEPTED?
Moderators may or may not accept that the issue you report is offensive
according to this policy. Borderline cases may be permitted.
WHAT TO DO IF YOUR POST IS MODERATED
If your post is edited or deleted, you will be sent a message by a Moderator.
Please refer to this document if you need clarification on an issue. If
you still don't understand why your post was moderated, then you may message
a Moderator by clicking moderator@asianaffair.com
In some cases posts may be edited. In some cases the post may stand but
a warning may be given.
YOU SHOULD NOT
• Post the same item again
• Abuse the Moderator for moderating your post
• Abuse other users of Asianaffair for reporting you
Any of these actions could result in a user account being cancelled.

It is possible that some users will be offended both by the content of the
site and by its moderation. If you are not satisfied with this Moderation

WARNINGS AND DELETION OF USERS
Warnings will be sent privately to offending users.
Infringements will result in your user account and posts being deleted.
Serious infringements or activity deemed unacceptable or illegal may result

TIMELINESS
We do not guarantee to moderate any post within a specific time period.
COMPLETENESS
We do not guarantee to moderate any post or topic completely.
OWNERSHIP AND LIABILITY OF POSTS
All views and material posted on Asianaffair are solely the opinion and
responsibility of the poster. By registering to use or using Asianaffair,
users grant a license to Asianaffair and its respective partners to publish
their material on the site.
Please read the Terms of Use and Terms and Conditions you accepted at the
time of registration for fuller information on the provisions you, your
parent or guardian has agreed to be bound by with regard to the material
you post on the site.
MODERATION POLICY
1. BASIC COURTESY TO ALL
Always show respect to other users of Asianaffair.
Asianaffair is not a venue for the resolution of personal disputes between
users or with other parties.
2. COMMERCIAL POSTS
Asianaffair is not a venue for unsolicited advertisements of any kind. It
will be at the sole discretion of Asianaffair and its Moderators as to what
constitutes an advertisement.
3. PERSONAL ADVERTISEMENTS
Personal or classified advertisements are not permitted. It will be at the
sole discretion of Asianaffair and its Moderators as to what constitutes
a personal advertisement.
4. PERSONAL INSULTS
Do not insult or wittingly offend other users. Personal insults nearly always
offend and will be checked. If someone insults you, do not insult them back.
Please report the action instead.
Posts generally taunting all users of a group will not be tolerated.
5. SWEAR WORDS
The use of swear words will not be tolerated. It will be at the sole discretion
of Asianaffair and its Moderators as to what word constitutes a swear word.
6. RACIAL SLURS
Racial slurs will not be tolerated. Discussion of whether a racial slur
is offensive or not is not permitted.
7. TROLLS
A troll is defined as a person who delights in sowing discord on the Internet.
Trolls start arguments and upset people. The relative anonymity of the Internet
allows trolls to flourish. In real life, such a person might be termed a
troublemaker.
A troll is not someone with an opinion that is different from your own.
Trolls will not be tolerated. Please report apparent trolls to the Moderators.
8. HARASSMENT, THREATS, STALKING
Harassment of other users in posts or messages is forbidden. Threats, stalking,
or other intimidating behaviour will result in immediate deletion of your
account.
9. GROOMING
‘Grooming’ is defined as the process by which a child abuser
seeks to prepare a minor for subsequent abuse. Child abusers are known to
use public interactive spaces, particularly those targeted at the young,
to seek out and meet minors.
When there is evidence that an adult intends to meet a child with the intent
of committing a sexual offence against them, either then or subsequently,
a criminal charge of “meeting a child following sexual grooming”
under Section 15 of the Sexual Offences Act 2003 can be brought.
If users believe they have been ‘groomed’ by another user of
Asianaffair, they should immediately report this to a Moderator by clicking
here Asianaffair will then investigate the claim, possibly by requesting
further information from the reporting user, and, if considered appropriate,
pass all relevant information to the appropriate authorities for investigation.
10. INCITING ILLEGAL BEHAVIOR
Posts about illegal behaviour are acceptable but posts inciting illegal
behaviour are not permitted. This includes but is not limited to posts inciting
the infringement of the intellectual property rights of third parties, such
as the reproduction of copyrighted imagery or logos or the copying of software
or music.
11. LINKS TO OFFENSIVE CONTENT ON THIRD PARTY SITES
Links to offensive or adult content on other sites is not permitted. It
will be at the sole discretion of Asianaffair and its Moderators as to what
word constitutes offensive.
12. FLAMING
Flaming, denigration and calls to action against any third parties will
be deleted. Direct attacks on corporations or individuals in those corporations
will be deleted.
13. REVEALING ANOTHER USER’S IDENTITY
Posting of another member’s profile information without their prior
consent will result in deletion of the poster’s account.
14. INAPPROPRIATE NICKNAMES
Nick names which are inflammatory, vulgar, promotional, rude or offensive
will not be permitted.
15. GRAPHICS & IMAGERY
Images that contain nudity or that are of a sexual or provocative nature
will not be permitted.
Images containing violence, scenes of death, of a sadistic nature or that
are generally tasteless will not be permitted.
16. ENGLISH
Asianaffair is an English-language community. Participants from all countries
are welcome but please do not post in languages other than English.
17. COMMENTS ABOUT ADVERTISERS
Negative comments about the advertisers who help make Asianaffair financially
viable are not permitted. We reserve the right to delete any comment that
may result in loss of revenue for Asianaffair.
18. ACTS AGAINST ASIAN AFFAIR LTD.
Any act against Asianaffair such as an attempt to hack or disrupt the normal
operation of the site or the incitement to commit such act in posts will
result in the account of that user being deleted and should the case warrant
it further action may be taken following the results of an investigation.
